Introduction

RUSNAK CORPORATION and each of our subsidiaries and affiliated entities under common ownership and control (collectively, “Dealership” or “we” or “us”) respects your privacy and the information that you have entrusted to us. This Privacy Policy describes our collection, use and disclosure of the information we may collect from you whenever you visit the Dealership’s physical location(s) or website(s) (hereinafter a “Site” and collectively the “Sites”), or otherwise access any of our other products, services, and content (hereinafter “Services”). This Privacy Policy applies to all visitors and customers of our Sites, including those consumers and/or customers who apply for and/or receive financing for personal, family or household purposes. If you become an inactive customer, or if we close or suspend your account, we will continue to adhere to the Privacy Policy in place when we collected your personal information as long as we retain it in our databases. We may delete any or all of your information at any time without notice to you or for any reason or no reason unless we are otherwise required by law or retain it.

The purpose of this Notice at Collection is to provide consumers with information about the categories of personal information that our dealerships collect about them and the purposes for which the personal information will be used.

We collect the following categories of “personal information”, as defined in the CCPA, relating to California residents and businesses:

  • Age and Veteran Status under state or federal laws, which may include information such as age (date of birth) and veteran status (to determine eligibility for military or similar rebates and comply with the Military Lending Act).
  • Audio / Video / Visual / Electronic such as photographs, recorded calls, voicemails, and online & electronic communications, such as those made via a live or automated online chat module.
  • Commercial such as vehicles, products, services, and repairs purchased, obtained or considered; personal property records (e.g., vehicle titles and registration cards); or other purchasing or consuming histories or tendencies.
  • Customer Records such as digital and electronic signatures, telephone numbers, insurance policy numbers, credit and debit card numbers, financial and credit-related information, physical characteristics and descriptions (e.g., government identification), bank account numbers, and medical and health insurance information (in the context of employment).
  • Education such as diplomas and transcripts for student rebate eligibility.
  • Geolocation Data (non-precise) such as locational data based on visitor IP addresses.
  • Identifiers such as real name, postal address, IP address, email address, SSN, driver’s license number, passport number, cookies, pixel tags, and similar identifiers.
  • Inferences to create a profile about you reflecting your product or vehicle preferences, purchasing tendencies and behaviors.
  • Internet Activity such as interactions with our websites, applications, and advertisements.
  • Professional/Employment such as job title, occupation, company or business name, and employment history information.

We use the categories of personal information listed above for one or more of the following “business purposes” listed in the CCPA:

  • Advertising & Marketing to send advertisements and marketing material via physical and electronic mail relating to product specials and other promotional events or offers, perform marketing research and data analytics, and perform similar activities.
  • Contextual and Behavioral Targeting to provide contextual customization of ads shown as part of an interaction with our website or application, such as through the use of “first-party” or “session” cookies.
  • Counting Ad Impressions & Website Interactions to audit interactions with our websites, applications, or advertisements, count ad impressions to unique visitors, verify position and quality of ad impressions, and perform similar activities.
  • Customer Service to provide customer service, maintain and service products and accounts, provide training for quality assurance purposes, and perform similar activities.
  • Defending Against Claims & Litigation to defend against or respond to potential or actual claims and litigation, including, but not limited to, those against the manufacturer of a particular vehicle we've sold.
  • Fraud Prevention to help ensure security and integrity, such as necessary to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to prosecute those responsible for that activity.
  • Processing Transactions to process or fulfill orders and transactions, verify customer information, process payments, confirm eligibility for manufacturer rebates, and perform similar activities.
  • Providing Financing to provide financing in connection with a vehicle purchase, lease or related products or services.

In the context of employment, we also use the categories of personal information listed above for one or more of the following business purposes:

  • Claims & Benefits Administration to process claims, administer benefits, and conduct employee drug tests in accordance with applicable laws.
  • Determining Employment Eligibility to determine eligibility for employment, verify references and employment history, and conduct background checks.
  • Employee Engagement & Emergency Contact Communications to communicate and engage with employee across the organization, enhance company morale by acknowledging significant events (e.g., birthdays, work anniversaries, etc.) and reaching out to emergency contacts listed for employees.
  • Employee Onboarding to conduct employee onboarding.
  • Employee Productivity to ensure employee productivity and adherence to company policies.
  • Human Resources Support & Services to provide employees with human resources management services and employee data maintenance and support services.
  • Internal Audits & Investigations to conduct internal audits and investigate complaints, grievances, and suspected violations of internal policies.
  • Monitoring Driving Records to monitor employee driving records as required or allowed by state and federal law.
  • Performance Evaluations & Customer Satisfaction to evaluate employee performance during the service and/or sales process and monitor customer satisfaction.
  • Preventing Unauthorized Access to prevent unauthorized access to or use of company property, including information systems, electronic devices, network, and data.
  • Public Health and Safety to conduct screening or temperature checks for COVID-19 symptoms or similar screening activities related to public health and safety.

We collect the following categories of “sensitive personal information”, as defined in the CCPA, relating to California residents:

  • Account or Credit Card Info Combined with a Security/Access Code such as account login information, credit or debit card numbers, or financial account information that is combined with a security or access code.
  • Biometric Data for Identification Purposes such as fingerprints and facial recognition used to identity you for the purposes of identity verification and fraud and theft prevention. May also be processed in the context of employment.
  • Citizenship, Immigration Status, or National Origin such as information contained on a credit application or government-issued identification document, or in the context of employment.
  • Contents of Communications such as a consumer’s mail, email, and text messages unless the business is the intended recipient of the communication.
  • Gender (Including Transgender or Non-Binary Status) which may be contained on a government-issued identification document.
  • Government-Issued ID Numbers such as social security, driver's license, state identification, or passport numbers.
  • Health Information such as mental or physical condition or diagnosis. Processed as necessary to administer employee health benefits, make reasonable accommodations, and respond to work-related illnesses and injuries.
  • Precise or Specific Geolocation Data such as tracking and online user-enabled location identification that is accurate within a radius of 1,750 feet (1,850 feet in California).
  • Race, Ethnicity, Religion, Philosophical Beliefs, or Union Membership which may be collected in the context of employment.
  • Sexual Orientation such as information collected concerning a consumer’s sex life or sexual orientation, in the context of employment.
  • Status as a Victim of a Crime which may include information processed in the context of employment.

The purpose of this California Privacy Policy is to provide consumers with a comprehensive description of our dealership’s online and offline practices regarding the collecting, use, disclosure, and sale of personal information and of the rights of consumers regarding their personal information under the CCPA.

The tables below describe how we collect, use, and disclose California consumers’ personal information based on definitions laid out in the CCPA. Please note that because the categories of personal information collected and shared largely depends on how a consumer has interacted with our dealership, not all of the items listed in the tables below will be relevant to you. For example, we generally only collect veteran status when a consumer qualifies for a military rebate. Similarly, certain pieces of information, such as health and medical information, are only collected in the course of administering employment benefits and claims, but are not collected from customers.

Your Rights Under the CCPA

1. Right to Know About Personal Information Collected, Disclosed, or Sold

Under the CCPA, you have a right to request that we disclose the categories of personal information we have collected, used, disclosed, and sold. We call this as a “categories” request. You also have the right to request that we disclose the specific pieces of personal information that we have collected about you, which we call a “specific pieces” request. These are referred to collectively as “Right to Know” requests under the CCPA.

2. Right to Request Deletion of Personal Information

You also have a right to delete the personal information we’ve collected about you. The “Right to Delete” is subject to several legal exceptions, such as when we are required by another state or federal law to retain your information.

3. Right to Opt-Out of the Sale or Sharing of Information

The CCPA provides consumers with the right to opt-out of the sale of their personal information and sharing of their personal information for cross-context behavioral advertising. The CCPA defines a "sale" as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration. Cross-context behavioral advertising is defined as the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across businesses, distinctly-branded websites, applications, or services with which the consumer does not intentionally interact.

While we do not sell personal information for monetary value, we may disclose personal information to third parties, such as vehicle manufacturers, in such a way that may be considered a “sale” of personal information under the CCPA. We also share information with third-party advertising companies for cross-context behavioral advertising to identify and present advertisements tailored to your behavior (e.g., retargeting ads). We do not sell or share personal information of minors who we know are under 16 years of age.

4. Right to Non-Discrimination for the Exercise of Your CCPA Rights

You have a right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

5. Right to Correct Inaccurate Personal Information

You have a right to correct any inaccurate personal information that we store on you.

6. Right to Limit the Use & Disclosure of Sensitive Personal Information

Under the CCPA, you have the right to limit the use and disclosure of your sensitive personal information for the purpose of inferring characteristics about you. Under California law, “sensitive personal information” includes, but is not limited to, your precise geolocation data, ethnicity, or social security, government-issued identification, bank account, or credit card number.

We may use and share certain categories of your sensitive information, such as geolocation data collected on our website, to infer characteristics about you. Verification of Right to Know, Correction and Deletion Requests

To protect against fraud, identity theft, and the unauthorized disclosure or deletion of personal information, we require that consumers submitting requests under the CCPA first verify their identity. This may include a combination of SMS (text message) verification, email verification, and one or more questions regarding the consumer’s particular interaction or transaction with our dealership. If the consumer fails to verify their request via these methods, or the information provided by the consumer otherwise does not match our existing records, we will deny the request.

Authorized Agents

A consumer may designate an authorized agent to make a request under the CCPA on the consumer’s behalf. If a consumer wishes to authorize another person to act as an authorized agent on the consumer’s behalf, the consumer must provide the authorized agent permission to do so. An authorized agent can submit a CCPA request on behalf of a California resident by clicking here.

To help prevent fraudulent requests, we reserve the right to deny a request from an agent that does not submit proof that he or she has been authorized by the consumer to act on the consumer’s behalf. As proof that the agent has been duly authorized by the consumer to submit a CCPA request, the agent will be required to upload either (1) power of attorney signed by consumer, or (2) other signed permission from the consumer. Pursuant to California Probate Code Sections 4300 to 4310, if an agent provides power of attorney signed by the consumer (“principal”) that purports to give the agent authorization to submit the request on the principal’s behalf, we may require that the agent provide information reasonably necessary or appropriate to identify the agent and principal and to facilitate the request. This includes, but is not limited to, identification of the agent and principal and the current and permanent residence addresses of the principal. If the agent provides some other signed permission from the consumer, we may require that the consumer (1) verify their identity directly with us through a combination of SMS (text message) verification, email verification, and one or more questions regarding the consumer’s particular interaction or transaction with our dealership and (2) confirm that he or she provided the authorized agent permission to submit the request.

Collection of Anonymous Information

How We Respond To Do-Not-Track Signals & Universal Opt-Out Mechanisms

A “do-not-track” signal is a privacy preference feature in some web browsers that tells a website that a user does not want their online activity to be tracked. We currently support Do Not Track (“DNT”) and Global Privacy Control (“GPC”), specifications designed to allow internet users to notify businesses of their privacy preferences, such as whether or not they want to be tracked or have their personal information sold or shared with third parties for targeted advertising. These specifications consist of a setting or extension in the user’s browser or mobile device and act as mechanisms that our websites can use to honor your privacy settings. Security

We implement reasonable security measures to ensure the security of your personal information. However, no data transmissions over the Internet can be guaranteed to be 100% secure by nature. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk. We may attempt to notify you electronically of any security system breach so that you can take appropriate steps. By using the Services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. We may post a notice via our website if a security breach occurs or send an email to you at the email address you provided. You may have a legal right to receive notice of a security breach in writing depending on where you live.

While we use encryption to protect online information, we also make all reasonable efforts to secure and protect your information offline. All of our customers’ information is restricted in our offices and only employees who need the information to perform a specific job function are granted access to this information. The services that store your personal information are housed in a secure environment.

Business Transfers and Related Activities

We may share or transfer your information in the course of any direct or indirect reorganization process such as, but not limited to, mergers, acquisitions, divestitures, bankruptcies, and sales of all or a part of our assets. Your information may be shared as a result of such transaction and/or during the assessment process pending transfer. In the event your information is transferred due to one of these events, know that your information would remain subject to this Privacy Policy or a privacy policy that protects your privacy to an equal degree as this Privacy Policy.

Chat Modules

We (or our third-party vendors on our behalf) may collect certain categories of personal information from you when you use our interactive chat module. In addition to the information you may enter into the chat box or live chat feature, the categories of personal information include, but are not limited to, name, phone number, email, mailing address, and other identifiers you may provide. Additionally, we (or our third-party vendors on our behalf) may also store any transcripts from such conversations and link those transcripts with your personal information. We (or our third-party vendors on our behalf) may also collect information from you to perform data analytics and thereby enhance your experience and help improve the functionality of our tools and digital advertising in an effort to present to you only relevant products and services. Such information includes, but is not limited to, geolocation, IP address, pixel tags, browsing history, viewing behavior, clicks, online activity, and other analytics. By interacting with the chat module, you understand and agree that we may use this data to communicate with you about our products and services. You also consent to our collection and analysis of all personal information provided as part of the chat module and understand that we utilize a vendor to process, analyze, and store the content of the chat on our behalf. By using the chat module, you are consenting to us disclosing and sharing with the chat module vendor any information (including personal information) you provide.

Use of Session Replay Tools

We (or our third-party vendors on our behalf) may collect certain categories of personal information from you when you interact with our website(s) or application(s) through the use of session replay tools. Session replay is a tool that recreates your sessions from our websites or applications (including visual elements), giving us (or our third-party vendors on our behalf) a better understanding of how you interact with our websites and applications to help maximize the customer’s experience. Session replay tools that we may utilize include, but are not limited to, video-like playback, error tracking integration, application performance monitoring (APM) integration, real user monitoring (RUM) session timeline, and speed controls. Depending on your interaction with our website (e.g. when you complete a “Contact Us” form), the categories of personal information we may also capture include, but are not limited to, name, phone number, email, mailing address, and other identifiers that you may provide. By interacting with our website(s) or application(s), you are consenting to us (or our third-party vendors on our behalf) capturing any interactions and any information (including personal information) you provide.

Your California Privacy Rights

California Civil Code Section 1798.83 permits visitors to our Sites and users of our Services who are California residents to request, once a year, certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Children Under 13 Years of Age

Our Sites and Services are not intended for children under thirteen (13) years of age. Dealership does not knowingly collect or use and personal information from children under thirteen (13) years of age, and does not knowingly provide any personal information to any third party for any purpose whatsoever from visitors younger than thirteen (13) years old. If you are under thirteen (13) years old, please do not provide any information on our Sites or through our Services.

Use of Cookies & Similar Technologies

We use cookies and other similar technologies (e.g. web beacons, tracking pixels, scripts, fingerprinting, and local storage) to deliver content specific to your interests, track your website activity, help our Sites remember you, enhance your online experience with us, and provide you with information you’re most likely to need. Cookies are small pieces of text used to store information on web browsers. Cookies and any technology that serves a similar purpose as a cookie in the context of tracking users/devices, identifying users/devices, processing information that users or their devices send to or through the Site, or building consumer profiles are included in our use of the term “cookie” for the purpose of this Privacy Policy. 2. Cookie Purpose Categories  

  • Essential Cookies. 

Essential cookies refer to cookies that are critical for the functioning of a website. These cookies enable basic features such as page navigation, and access to secure areas of the website. Essential cookies are typically used to maintain a user's session, store authentication information, hold shopping cart items, comply with state or federal laws (e.g., accessibility or cookies preferences), and ensure the security of transactions. Without these cookies, a website may not work, or may not be able to provide certain basic services or features, and its performance may be affected​. Essential cookies can be first-party cookies or third-party cookies. Our Sites do not support an inherent mechanism to allow users to opt-out of essential cookies.

They are also used to limit the number of times an ad is shown and to help measure the effectiveness of advertising campaigns. Dispute Resolution, Arbitration Agreement, Class Action Waiver

 

Initial Dispute Resolution Procedure 

Notice of Dispute, Requirement to Attempt to Resolve Disputes Informally. 

By visiting the Sites and/or using the Services you and Dealership agree that if there is any controversy, claim, action, proceeding, demand, or dispute arising out of or related to your visit to the Sites, use of the Services, or the breach, enforcement, interpretation, or validity of this Privacy Policy or any part of it (hereinafter “Dispute”), both you and we shall first try in good faith to resolve such Dispute informally by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party thirty (30) calendar days in which to respond to or resolve the Dispute. Notice shall be sent to us at ATTN: Rusnak Auto Group, Attention CCPA, PO Box 70489 Pasadena, CA 91117 , and to you at the address or email we have on file for you. Both you and the Dealership agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. This notice and informal resolution requirement will not apply to the extent it is prohibited by law.

Arbitration, Class Action Waiver. 

IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE INITIAL DISPUTE RESOLUTION PROCEDURE, WE BOTH AGREE THAT THE DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. 

This means that if you and we have a Dispute that is not resolved in the informal process described in section 3.1 above, we both agree to resolve it through arbitration. Arbitration means that a neutral third party will hear both sides and make a decision. This is different from a court trial, where a judge or jury hears the case in a formal court setting and makes a decision. We both agree not to sue each other in court. 

This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16). The arbitration will be before a single arbitrator and the arbitrator’s decision will be final and binding on both of us.

The arbitration will be held pursuant to the rules of the American Arbitration Association - Consumer Arbitration Rules (if you are a business, the American Arbitration Association - Commercial Arbitration Rules will apply instead) (as applicable, the “Rules”). You can access a copy of the rules at: www.adr.org/rules. The Rules provide the steps required to start an arbitration case. 

This arbitration agreement does not apply to Disputes that you or we bring against the other party that are within the jurisdiction of small claims court. If the amount in controversy of a Dispute in small claims court exceeds the jurisdiction of the small claims court, that Dispute will be subject to this arbitration agreement. 

Class action waiver. We both agree that any Dispute will be handled individually. This means that you or we cannot join together with other people who have a similar problem to bring a single case against the other party. You also cannot be part of a class action lawsuit (or class action arbitration) against us, and we cannot be a part of a class action lawsuit (or class action arbitration) against you.

By using our Services, and visiting our Site, you agree to this arbitration agreement and class action waiver. If you do not agree, please do not use our Services or visit our Site.

If any part of this arbitration agreement and/or class action waiver is found to be invalid or cannot be enforced, the rest of the arbitration agreement and class action waiver will still apply. The arbitrator will decide if any part is invalid or cannot be enforced.

Other Arbitration Agreements

In the event of a conflict between this arbitration agreement and any other arbitration agreement between you and the us, such as an arbitration agreement contained in a retail installment sale contract, purchase order, lease agreement, or repair estimate (hereinafter “Other Arbitration Agreement”), the terms of the Other Arbitration Agreement shall govern and prevail in each instance.

Venue And Choice Of Law

This Privacy Policy has been made in, and shall be construed in accordance with the laws of California without giving effect to any conflict of law principles. Any disputes or claims not subject to the arbitration provision discussed above shall be resolved by a court located in that state and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

If any part of this Privacy Policy is found to be invalid or cannot be enforced, the rest of the Privacy Policy will still apply.

Privacy Policy Supplement for the Foureyes Tool

This Foureyes supplement to the Dealer's Privacy Policy ("Privacy Policy Supplement") addresses how personal information is collected, used, disclosed, and otherwise processed by Foureyes, LLC and its subsidiaries and affiliates ("Foureyes") on behalf of the automotive dealers and dealer or automotive group customers that are using the Foureyes Tool (collectively, the "Dealer(s)").

The Dealer posting or linking to this Privacy Policy Supplement uses the Foureyes platform and tools (such as Foureyes' analytics and reporting system and/or Foureyes' customer communications hosted system) (collectively, the "Foureyes Tool" or the "Tool"). Foureyes is operating as a service provider/processor to the Dealer and processing personal information on the Dealer's behalf.

For information about data rights available under U.S. state privacy laws and the California Notice at Collection, please see the State-Specific Privacy Addendum to the Dealer Privacy Policy Supplement .

Please also review the Dealer's Privacy Policy, Terms and/or any other applicable terms or agreement that may apply to your use of the Dealer's website or other services. If you have any questions, comments, or concerns, please contact the Dealer directly.

From time to time, Foureyes may update this Privacy Policy Supplement as described in the Changes to this Privacy Policy Supplement section below.

1. Scope of This Privacy Policy Supplement

  • The Foureyes Tool
    This Privacy Policy Supplement applies to personal information that Foureyes collects, uses, discloses, and otherwise processes on behalf of the Dealer when you access, use or otherwise interact with the Dealer's website or otherwise communicate or engage with the Dealer where the Dealer has implemented the Foureyes Tool. 
    This Privacy Policy Supplement covers only processing via the Foureyes Tool and no other processing by the Dealer. For information about how the Dealer processes personal information, please refer to the Dealer's privacy policy.
  • Out of Scope This Privacy Policy Supplement does not apply to processing activities by Foureyes that are not described in this Privacy Policy Supplement, including but not limited to processing activities for which Foureyes acts as a business/controller.

This Privacy Policy Supplement does not apply to the Dealer website or processing activities occurring on the Dealer website outside the scope of the Foureyes Tool. It also does not apply to Dealer communications occurring outside the Foureyes Tool or other processing activities performed by the Dealer. For information about how the Dealer processes personal information, please refer to the Dealer's privacy policy.

This Privacy Policy Supplement does not apply to or cover websites or resources that are not connected with the Foureyes Tool, with which Foureyes does not have a contractual relationship and over which Foureyes does not have control ("External Websites"). By clicking on links to External Websites, the operators of the External Websites may collect personal information. Foureyes is not responsible for the content or data collection practices of those External Websites, and your use of External Websites is subject to their respective terms of use and privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

2. How the Foureyes Tool Works
The Foureyes Tool collects, generates and otherwise processes personal information when you interact with the Dealer's website, engage with the Dealer by phone, or by filling out a form or interacting with chat functionality on the Dealer's website, and/or receive and interact with email communications and/or SMS messages from the Dealer, where the Dealer's website and/or communications are connected with or sent and received through the Foureyes Tool. For more information about how the Foureyes Tool works and your opt-out options,

3. Personal Information Processed by the Foureyes Tool
As used in this Privacy Policy Supplement, 
"personal information" means any information that identifies or could be used to identify an individual person. For example, personal information may include name, email address, and IP address, or other unique identifier. It also includes other non-public information that is associated with such identifying information. Personal information does not include aggregated or anonymized information.

The Foureyes Tool collects the following types of personal information on behalf of the Dealer:

  • Information You Provide
    • Contact Information: The Foureyes Tool collects contact information that you provide in your interactions with the Dealer, such as by submitting a contact form or communicating with the Dealer by phone, email or chat. This includes information such as your name, personal phone number, home address, and email address.
    • Customer Profile: When you interact with the Dealer website, the Foureyes Tool generates a unique visitor ID number and visitor traffic number and creates a user profile. The Foureyes Tool collects information that a user provides through the Dealer website and interactions with the Dealer, as described in this Privacy Policy Supplement, and includes that user-provided information in the user profile. The Foureyes Tool also combines information collected automatically (described below) with user profile information for the same individual.
    • Chat and Phone Communications: The Foureyes Tool collects information that you enter into or through a chat feature or functionality made available on the Dealer website and/or information provided through phone communications with the Dealer. This information may include contact information and the content of any chats that you provide, including any inquiries or requests and your chat history.
    • SMS messaging and Marketing Emails: The Foureyes Tool collects your contact information and the content of your email communications with the Dealer. If you provide the Dealer with consent to receiving text messages, the Foureyes Tool may collect the phone number that you provide and your messaging history including any information included in those messages. Mobile information will not be shared with third parties for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.
  • Information Collected Automatically
    • Log data: This may include your Internet Protocol ("IP") address, browser type and settings, the date and time of your request, and how you interact with our Services.
    • Device information: This may include your browser type and version, browser settings, time zone, unique device identifiers, available plugins, information about your approximate location (as determined through your IP address), mobile, computer, and/or device hardware information (e.g., operating system version, hardware model, IMEI number, and other unique device identifiers, MAC address, and device settings), device event information, log information, and crash data.
      • Usage information: This may include features that you use, clickstream data, access dates and times, and how you interact with the Dealer website. This information may also include the traffic source for the visit, referring / exit pages and URLs, how you interact with links on the Dealer website, landing pages, and pages viewed. The Foureyes Tool also may collect the date and time you open an email communication or click on any links in an email sent via the Foureyes Tool, and the Foureyes Tool may associate this information with the email address we already have from you.
  • Information from Third Party Sources
    The Foureyes Tool may access or receive information from third-party sources that the Dealer connects or uploads to the Foureyes Tool. These third-party sources of information may include the Dealer's internal and/or third-party business operations and marketing systems and other third-party service providers to the Dealer, such advertising or analytics vendors.
  • Sensitive Personal Information The Foureyes Tool does not intentionally collect personal information that is considered sensitive under privacy laws, such as genetic data, health information, race or religious information, about users to provide the Services.

4. How The Foureyes Tool Uses Personal Information
The Foureyes Tool uses the personal information collected in the following ways:

  • To provide the Foureyes Tool and related services to the Dealer;
  • To assist the Dealer in establishing and managing a business relationship with you;
  • To send marketing communications, including emails and SMS messages, on the Dealer's behalf;
  • To analyze use of the Dealer website and communications;
  • To conduct research and analytics related to the Dealer's website and marketing activities, such as to understand how they are being used and where improvements may be needed;
  • To personalize and improve user experience on the Dealer's website and when interacting with the Dealer through personalized communications;
  • To compile aggregate and anonymized data for Foureyes' own use; and
  • For Foureyes' own legal and compliance obligations.

5. How the Foureyes Tool Discloses Personal Information
On behalf of the Dealer, Foureyes transmits, discloses, grants access, makes available or provides personal information to or with the following types of third parties.

  • OEMs and their Digital Program Operators: Foureyes partners with various automotive manufacturers and their affiliates ("OEMs") as a part of their respective certified marketing programs and discloses personal information collected and generated through the Foureyes Tool with them, as set out under Forueyes' agreements with the Dealers and OEMs. Foureyes also discloses personal information to the third-party operators that provide the OEM with digital marketing and sales program technology platforms and program management ("Digital Program Operators"), according to Foureyes' agreements with the OEMs and the relevant Digital Program Operators.
  • Connected Data Partners: If the Dealer has established a relationship with a third-party partner that connects data with the Foureyes Tool ("Connected Data Partner"), Foureyes discloses personal information with the relevant Connected Data Partner, as set out under Foureyes' agreements with the Dealer and the Connected Data Partner.
  • Foureyes' Service Providers: Foureyes discloses personal information with its own service providers that help Foureyes to provide the Foureyes Tool.
  • Third Parties Related to Legal and Compliance: Foureyes may disclose personal information as required to meet its own legal and compliance requirements, as described in Foureyes' own privacy policy.

      Please note that the opt out applies only to email communications sent via the Foureyes Tool and only for the particular Dealer whose communications you've opted out of. You may continue to receive other marketing emails sent by the Dealer or the Dealer's third-party service providers or agents, and you may continue to receive marketing emails from other Dealers that use the Foureyes Tool. To opt out of other marketing communications sent by the Dealer, please see the Dealer's privacy policy for the relevant opt-out information. To opt out of email communications sent by the Foureyes Tool on behalf of other Dealers, you will need to submit a separate opt-out request with Foureyes for each Dealer.
      If you opt-out of marketing emails sent via the Foureyes Tool, the Dealer will still send you transactional emails, such as responses to your requests.
    • SMS Opt-Out: To stop receiving SMS marketing communications sent via the Foureyes Tool on the Dealer's behalf, you can opt out at any time by responding with an opt-out notice in the SMS communication.

Please be aware that the Dealer may engage in targeted advertising through its third-party advertising partners. The Foureyes Tool does not serve targeted ads, and Foureyes does not directly engage in targeted advertising on the Dealer's behalf. For information about the Dealer's targeted advertising activities and your options, please see the Dealer's privacy policy.

7. Your Privacy Rights and U.S. State Privacy Disclosures
Depending on the state where you reside, you may have certain privacy rights provided under applicable law. For more information, please see the 
State-Specific Privacy Addendum to the Dealer Privacy Policy Supplement .

8. How Long Foureyes Retains Personal Information
Foureyes retains personal information for the purposes stated in this Privacy Policy Supplement, as directed by the Dealer and as required or permitted under applicable law. To determine how long we keep personal information, we consider the amount, nature, and sensitivity of personal information, the reasons for which we collect and process the information, and applicable legal requirements.

9. How Foureyes Protects Personal Information
At Foureyes, we take our responsibility to protect the security and privacy of personal information seriously. The Foureyes Tool has implemented what Foureyes believes to be reasonable and appropriate administrative, technical, and physical data security measures designed to prevent personal information from being lost, used, accessed, altered, or disclosed in an unauthorized or unlawful way.

However, no method of transmission over the Internet, or method of electronic storage, is 100% secure, and we cannot and do not guarantee that personal information is completely secure and safe from such risks. If you have reason to believe that your information is no longer secure, please contact the relevant Dealer.

10. "Do Not Track" Preferences
Some Internet browsers may be configured to send "Do Not Track" signals to the online services that you visit. There is no consensus among industry participants as to what "Do Not Track" means in this context. Like many websites and online services, the Foureyes Tool does not currently alter its practices when a "Do Not Track" signal from a visitor's browser is sent, except as specifically required by law. 11. Children's Privacy
The Foureyes Tool does not knowingly collect personal information from children younger than the age of 18 or under the age of majority without the consent of a parent or legal guardian, as required under applicable law. If you learn or believe that a child under the age of 18 or under the age of majority has provided us with personal information, please contact the relevant Dealer.

12. Changes to this Privacy Policy Supplement
Foureyes may update this Privacy Policy Supplement from time to time. When Foureyes updates this Privacy Policy Supplement, we will revise the "Last Updated and Effective Date" at the top of this Privacy Policy Supplement and post a link to the updated Privacy Policy Supplement. Changes to this Privacy Policy Supplement are effective when they are posted. If Foureyes makes any material changes, the Dealer may provide you with notice as required under applicable law. Please review this Privacy Policy Supplement periodically to ensure you are aware of any such changes
